Terms of Service

These Terms of Service ("Terms") govern your access to and use of Radi8 (the "Services"). The Services are offered by Custany, LLC (doing business as Radi8). By using the Services, you agree to these Terms. If you do not agree, do not use the Services.

Eligibility

You must be at least 13 years old to use the Services. If you are using the Services on behalf of a company or organization, you represent that you have authority to bind that entity to these Terms.

Your Account

You are responsible for your account credentials and for all activity that occurs under your account. You agree to provide accurate information and to keep your account information up to date.

Use of the Services

You agree not to:

• Use the Services in any way that violates applicable law.
• Interfere with or disrupt the Services or systems.
• Attempt to access the Services without authorization.
• Reverse engineer, copy, or resell the Services except as allowed by law.

Connected Third-Party Accounts

The Services let you connect accounts on third-party platforms (such as Instagram, LinkedIn, and X) to publish, schedule, and analyze content. Your use of those platforms remains subject to their own terms and policies, and you are responsible for compliance with them. By connecting an account, you authorize Radi8 to access and act on the platform on your behalf within the scope of the permissions you grant. You may disconnect a connected account at any time through the Services or through the third-party platform itself. Radi8 is not affiliated with, endorsed by, or sponsored by these platforms, and we are not responsible for their availability, content, or actions.

Content and Data

You retain ownership of content you submit or upload to the Services. You grant Radi8 a limited license to use that content to provide, maintain, and improve the Services. You are responsible for the content you submit and for having the rights to use it.

Copyright and DMCA

Radi8 respects intellectual property rights and complies with the Digital Millennium Copyright Act ("DMCA"). If you believe content accessible through the Services infringes your copyright, send a written notice to support@radi8.com that includes:

• Your physical or electronic signature.
• Identification of the copyrighted work claimed to be infringed.
• Identification of the allegedly infringing material and information sufficient for us to locate it.
• Your contact information (address, telephone number, email).
• A statement that you have a good-faith belief that the use is not authorized by the copyright owner, its agent, or the law.
• A statement, made under penalty of perjury, that the information in the notice is accurate and that you are the copyright owner or authorized to act on the owner's behalf.

We may remove or disable access to material claimed to be infringing and may terminate accounts of repeat infringers. If you believe content was removed in error, you may submit a counter-notice to the same address with the information required by 17 U.S.C. § 512(g).

Subscriptions and Payments

Some features may require payment. If you subscribe, you agree to pay all applicable fees and taxes. Unless otherwise stated, fees are non-refundable. We may change pricing or fees with notice.

Privacy

Our Privacy Policy describes how we collect and use information. By using the Services, you agree to our Privacy Policy.

Feedback

If you provide feedback, ideas, or suggestions, you grant Radi8 a perpetual, worldwide, royalty-free license to use them without restriction or compensation.

Disclaimer of Warranties

The Services are provided "as is" and "as available" without warranties of any kind, express or implied.

Limitation of Liability

To the maximum extent permitted by law, Radi8 and its affiliates will not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenues.

Indemnification

You agree to defend, indemnify, and hold harmless Radi8, Custany, LLC, and their officers, directors, employees, and agents from and against any claims, liabilities, damages, losses, and expenses (including reasonable attorneys' fees) arising out of or in any way connected with: (a) your access to or use of the Services; (b) content you submit, upload, or publish through the Services; (c) your violation of these Terms or applicable law; or (d) your violation of any third-party right, including any intellectual property, privacy, or publicity right.

Termination

You may stop using the Services at any time. We may suspend or terminate access to the Services if you violate these Terms or if we discontinue the Services. Sections intended to survive termination will survive.

Governing Law and Dispute Resolution

These Terms are governed by the laws of the State of California, without regard to its conflict-of-laws principles. You and Radi8 agree that any dispute arising out of or relating to these Terms or the Services will be resolved exclusively in the state or federal courts located in California, and each party consents to the personal jurisdiction and venue of those courts. Nothing in this section prevents either party from seeking injunctive or other equitable relief in any court of competent jurisdiction to protect its intellectual property or confidential information.

Changes to These Terms

We may update these Terms from time to time. We will post the updated Terms here and update the effective date above.
